Zapopan, Jalisco Notary No. 7, is committed to the protection of your personal information, being responsible for their use, management and data confidentiality, having said that, informs you the following:

I. PURPOSE OF USE OF YOUR PERSONAL INFORMATION.

This Notary collects your personal information for compliance with the following purposes:

  • To confirm your identity.
  • To better understand and attend your legal inquiries.
  • To provide security and legal certainty of the facts, acts and legal negotiations/transactions celebrated by public instruments, such as transfer of dominion operations related to sales-purchase agreements, donations, exchanges, property transfers, awards by inheritance, awards by auction, trusts, constitution of condominium regime, wills and inheritances, mortgages and mortgages cancellations, signature ratifications, expedition of faith of facts, certification of signature authenticity and notarized copies expedition.
  • To redact notary public instruments of your interest.
  • To perform administrative tasks to support the notarial exercise.
  • To provide advice and capture your desire onto a notary instrument in the framework of the Notarial Law of Jalisco.
  • To meet legal requirements, regulatory and any other that apply.
  • To verify the information you are providing to us.

In addition to this, we use your personal information to conduct evaluation surveys about the attention you received from the staff of this Notary, and offer new services or promotions. Although, the purposes mentioned above, are not necessary to provide any of the services you requested with us, they allow us to provide better service and improve our quality. In case you do not want your personal information to be processed for these purposes, in that moment, you can express your refusal to the staff of this Notary requesting the appropriate format.

The refusal to use your personal information for these purposes cannot be a reason to deny the services you requested to this Notary. Given the case you do not expose your refusal, we will understand you agree and authorize the use of your personal information for those purposes.

II. PERSONAL DATA USE

To provide the services you need, we require the following information:

  • Official ID (Passport, INE).
  • Date and place of birth.
  • E-mail.
  • Home address.
  • Job information (occupation, workplace, etc.).
  • Property (detailed list of the good properties you own).
  • Financial information.

Sometimes we can get to use personal data of a sensitive nature as those listed below:

  • State of health.
  • Religious beliefs.
  • Philosophical beliefs.
  • Affiliation.
  • Political opinions.
  • Sexual preferences.

III. WITH WHOM WE SHARE YOUR PERSONAL INFORMATION?

Sometimes, your personal data is shared to comply with legal requirements or to attend a founded and motivated order by the competent authorities in the exercise of their functions such as reporting, monitoring and keep control, specifically with the Registro Pùblico de la Propiedad y Comercio del Estado de Jalisco, or other Federal Entities, regarding the transfer of dominion operations, the Servicio de Administración Tributaria on taxation and judicial or local or federal administrative under Mexican law authorities.

We also, inform that if this Notary is forced or in the need to transfer your personal information to national or foreigners third parties other than those mentioned on the previous paragraph in compliance of our notarial services, you will be previously informed of this situation in order to request permission and inform about the recipients or third receivers and purposes of such transfers, in terms of articles 36 and 37 of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares and 68 of its Regulations.

In any case, we will communicate this privacy note to recipients of your personal information, so they can respect your terms.

IV. EXERCISE OF THE ARCO RIGHTS OR REVOCATION OF CONSENT.

You will be able to access, modify, cancel or oppose the treatment of your personal information that we have on our registries and archives, or revoke your consent for the use of these, by submitting a written request to our address for the person or department of privacy or via email to info@notaria7zapopan.mx

In this regard we wish to express that the exercise of ARCO rights or revocation of consent, is independent of changes to personal data recorded in public instruments that are issued in this Notary. Therefore, any action or request you may require with respect thereto shall be governed by the applicable law.

Your application must content, at least the following information:

  • Full name or your representative’s name, address or any other way to communicate the answer.
  • Documents proving your identity or your representative.
  • The clear and accurate personal data description for which you’re seeking to exercise your right.
  • Any other item or document that facilitates the location of personal information.

You must prove your identity through official and valid ID, or if you submitted your application through your representative, via a public instrument, you will need a power of attorney signed by two witnesses or statement of personal appearance of the owner.

We are committed to provide an answer within a maximum period of 20 working days from the day we receive your request, it will be at your disposal in our address if you submitted your application in this Notary, or via email if the exercise of your ARCO rights were requested by this mean, subject to proof of your identity.

If you request access to your personal data, the reproduction of these will be through simple copies, electronic file, or may consult them directly on site. If you request your right to rectify, your application must be accompanied by documentation that covers the origin of the request.
